Checklist

A checklist for working out where an AI system sits under the EU AI Act's risk tiers, and whether provider or deployer obligations apply.

Scope

  • Could this system be provided or deployed into the EU market?
  • Does it use a general-purpose AI model?
  • Is it embedded in a regulated product?

Risk tier

  • Could it fall under a prohibited practice?
  • Could it be high-risk under Annex III or Annex I?
  • If not high-risk, does it carry transparency obligations as limited-risk AI?

Obligations and deadlines

  • Is the organisation acting as provider, deployer, importer or distributor here?
  • Annex III high-risk use cases: track the 2 December 2027 transition.
  • Annex I embedded high-risk systems: track the 2 August 2028 transition.
